Below is an updated agenda given by CSX payroll as to when the pay increases and back time will be paid:

1. 4% increase will be included on the paycheck received on September 13th, 2002.

2.  Back time of 4% increase will be included on the paycheck received on September 27th, 2002.

3.  RCO (remote control) arbitrary (46 minutes) will be paid on October 11th, 2002.

4.  Longevity Bonus ($1200.00) will be paid on October 25th, 2002.

"FELT LEADERSHIP"

 

Under this new program, all employees will be

associated with a manager, who they can contact to assist the employee with any problem or concern they are having. You will be receiving a letter in the mail with more information on this new program.

On April 11, 2003 TN Gov. Bredesen signed

HB670/SB291 into law. This Act revises our "Passenger Contract Carrier Safety Act of 2002"

"Effective July 1,2003 every van must maintain a log book of hours on duty for the past 30 days. The log book must be presented for inspection by a law enforcement or any passenger upon request.

Violations of this section is a

 class C misdemeanor.

section 55-8-204. Hours of Service.

A) A passenger contract carrier shall not permit, or require

     any driver to remain on duty & he driver shall not drive:

          1) More than 12 hours following 8 consecutive hours

               off;

          2) If the driver's combined on-duty & drive time

               hours equal 15 hrs since obtaining 8 consecutive

               hours off-duty: or

          3) If the total number if hours of on-duty time & drive

               time exceeds 70hrs in a period of 8 consecutive      

               days.

Health Care Changes

It is time to vote for your Health Benefits!

Remember if it gets voted down, it automatically goes to arbitration,

where we stand to loose more!

If it gets voted in, you will see an automatic

payroll deduction ( pre tax ) of $119.61, starting in November,2003.

(not on the half when your union dues come out)

The deduction will be reduced to $100.00

effective in July,2004.

If you think that the $119.00 per month is too high, ask your friends& family

( who work in the private sector)

what they pay for their

health care coverage. You will see that we are coming out ahead, still.

 Things to Ponder

 

If you tie up your train at a milepost other than your final destination, enter the milepost that you tied up at on your time-ticket. If you are on a Switcher or Yard crew & are sent to bring in a train that went "dead", make sure to use the correct milepost on your time-ticket. Failure to do so violates F.R.A. Regulations.

 Things to Ponder

 

If you know that you are going to need a ride when you get to where you are going, like Widows Creek or when you Dog-Law, you can call for one in advance by telling the Dispatcher that you will need a ride. That way you won't be stranded waiting for a ride.

 

If you have a problem with P.T.I or lodging, fill out the complaint form at the end of your workorder & fax it to the number provided on the form. Once faxed, give it to your Local Chairman.

A Good Reasons to Join Or Stay a Member of the UTU

The Canadian Supreme Court  rules in favor of a lower court ruling that the BLET "breached its statutory duty of fair representation in negotiating 3 items of a collective bargaining agreement" with VIA Rail which resulted in all conductor positions being eliminated. The BLET must pay as much as

$230000.00(Canadian) each  to 230 former UTU Conductors. That's

$52,900,000.00 Canadian or $43,303,863.00 U.S.

Guess who is going to pay that money ..

The BLET members. If you don't want to pay higher dues,

Make the smart choice & stick with the UTU.

Good News

ERWIN, Tenn. -- CSX Transportation, which mismanaged a pool of conductors out of two subdivisions here, sought to cover-up its shortcomings by falsely alleging the UTU engaged in an unlawful work stoppage or slowdown. Carriers don't do that to the United Transportation Union -- at least not do it and succeed. When the case reached the court house, UTU General Chairperson Rufus McIntyre (GO-513) used statistical evidence to rebut CSX's baseless and hollow claims. The mismanaged railroad walked from the court house with considerable egg on its face.

SAVING JOBS AND SOLVENCY OF THE RAILROAD RETIREMENT SYSTEM

Brothers and Sisters, please find the attached material and read very carefully as the directives included are aimed at saving our members' jobs and the solvency of the Railroad Retirement System.  I cannot stress enough how important it is that you do whatever it takes to provide your members, active and retired, with the enclosed information and make sure they, as well as members of their family, understand the importance of acting together and following the directives included in this material.  
 Unity has never been more important than it is now with the attitude of the Railroads and Government toward our jobs, retirement, and working conditions. While we may all have our own opinions, we can not allow those opinions to divide and conquer.  We must put our opinions aside and act in unity.  I believe you will see that the 70,000 or 80,000 contacts made in the manner requested by your leaders will make a difference.
 
I urge you to not let this request for assistance be taken lightly.  Please take the time and effort to act on this request and the directives included in the attached material (NOTE: These efforts are to begin on Monday, February 6).  Do not let the Railroads' strategy force us to a Presidential Emergency Board and have that Board decide what your next agreement will be worth.  YOU NEED ONLY LOOK AT WHAT HAPPENED IN THE MID 80'S TO REALIZE WHO THE PEB WILL FAVOR.

When called to deadhead, make sure you are given a "Z" or "17" type deadhead, CMC has been sneaking in

"L" deadheads. You will not be paid for "L" deadheads, also "L" deadheads violate Article 12 of the

 UTU Agreement

Banner Tests (stickman) are on the rise, remember if you have any doubt as to if the engineer can stop short of the stickman, pop your "emergency brake" handle. The job you save may be your own.

 

Officials are  performing cell-phone stings. They will call your cell-phone to see if you answer it. Avoid using your cell-phone while on duty. If an Official comes on the radio & request that you call them, wait till you can get to a company phone & call them from that location. Remember, CSX did not issue you a cell-phone nor pay your wireless bill.

If your call is busted after the On-Duty time, you need to complete a Time Ticket.

ie: A crew is called for 1900hrs at Home Terminal.

at 2000hrs, CMC calls & says the call is Busted.

You must complete a Time Ticket, you will also have a minimum of 4 hrs off before being called back to duty,

this crew was on duty for 1hr before being relieved,  they hade 4 hrs off before being called back to work, they can only work for 11hrs. To be good for 12hrs of duty, they would have had to been off for 8hrs.

If you are at your Away-From-Home Terminal, & your call gets canceled after going on duty, your 4hrs does not begin until you check back into the hotel & contact CMC.

Attention all UTU Members,

Someone in Radnor Yard has posted a letter on the bulletin boards regarding the proposed loss of jobs on the Hump. They had implied that the Members of UTU Local 1346 would stage a "Work Slow-Down".

We do not know who wrote this letter, we hope they wrote it with good intentions rather with the intention of hurting the UTU.

THE UTU DOES NOT CONDONE OR SUPPORT THIS ACTION.

The writer of that notice does not speak for the Union. Probably he (she) is feeling frustrated at the thought of loosing their job.

CSX is Rolling Out NEW LOCOMOTIVE seats!

     I do not know about you, but those small seats are not that comfortable.  A picture of the new seats can be seen in the June/July issue of  "CSX TODAY" newsletter.  They look real comfortable.  I know I look forward to sitting in them.  If you already have had a chance to sit & ride in a new style seat, please write a review and send it to Tony Garcia, ito@utu974.com.

has it that CSX has/will start citing employees who

mark off on Thursday.

According to the Rumor, CSX believes that the

Weekend begins on Thursday. Also if you

mark off sick between Thurs. & Sunday you have to obtain a Doctors note.

2004 Safety Shoe Program

The 2004 Safety Shoe Program has been Finalized & includes some changes from what was announced in late 2003.

Transportation employees must complete their

 2004 Rules Training before March 31. Safety Certifications for Transportation employees will be available beginning in April. Upon successful completion of the

 Voluntary Safety Certification, Transportation employees will be eligible to order their safety shoes.
